NO ENCROACHMENT IN COMPLIANCE WITH FIRE DEPARTMENT (BOMBA’S) REQUIREMENT
In our efforts to pass the Building Safety Inspection by BOMBA, we request owners/ tenants to keep merchandise/ items within their premises. Please make sure you do not encroach and cause to disable the Fire Rated Roller Shutter from functioning properly to protect the complex in case of fire. The relevant authority has raised their concern, and the management seeks your cooperation to remove all belongings encroaching to the common passageway as these areas form part of the common property. Kindly refer to our Security Report dated on 22nd June 2020; we attach herewith the report for your further action.
Reference is made to the By-Laws which reads as follows:
“7.11 The Subsidiary Owner shall at all times ensure a free passage way on and around his Parcel and not encroach onto, use or enclose any parts of the Common Property for his benefit or otherwise nor display and/or offer for sale goods beyond the frontage boundary nor place any plumbing, shades, canopies, awnings, window boxes, amplifiers or other devices or things of any kind whatsoever exterior to his Parcel unless otherwise permitted by the MC in writing. The MC has absolute right to remove all encroachments into any part or parts of the Common Property and the Subsidiary Owner shall indemnify the MC for all costs and expenses incurred as a result thereof.”
This official notice demands that you remove all encroachments into any part of the Common Property. Failure to comply, the Management Corporation will commence removing all items encroached to the common property on the 1st July 2020 onwards.
All removed or confiscated property maybe claimed by the proprietor within fourteen days from the date of the notice. If a removed or confiscated property is not claimed at the expiry of the period of fourteen days, the Management Corporation may discard or dispose of such property as it deems fit without any liability to the proprietor.
Failing a fire safety inspection can be devastating for our entire business community. Violations can result in fines and citations that are expensive to pay off. If word gets out about a failed fire safety inspection, public opinion about our business community can fall dramatically, and you may cause other business operators within the community to suffer as a result. Worst of all, failing a fire safety inspection is a failure to keep our community out of harm’s way.
