Contract Analysis of Residential House Lease
A residential house lease is a legal contract between a tenant and Landlord; the agreement covers one or more tenants and landlords. The charter indicates the amount the Tenant is supposed to pay each month, and the duration the Tenant is required to occupy. It is crucial to lay down the regulations for the rental relationship between a tenant and a landlord. It shows what is expected for each party and also shows the consequences for the failure of meeting the conditions.
In the case of landlord Maria and tenant Juan, the Landlord has refused to fix the small roof leaking that has resulted to the formation of mold in the premises, Juan has the right to terminate the lease before the agreed date. This is because the Landlord has failed to comply with section C of the lease contract that states “Tenant agrees to promptly notify Landlord in the event of any damage, defect or destruction of the House, or the failure of any of Landlord’s appliances or mechanical systems, and except for repairs or replacements that are the obligation of Tenant under Subsection A above, Landlord shall use its best efforts to repair or replace such damaged or defective area, appliance or mechanical system.” Therefore the Landlord will suffer the consequences of losing a tenant and return the mount of the remaining time since the contract has been terminated.
