Ethical dilemma and legal standards
Healthcare has a set of rules, regulations, laws and the ethical standards that they follow. They help protect on decision making regarding the healthcare and help set the responsibilities for the healthcare professionals. There is a difference between legal and ethical rules. Legal standards are set by the government, while the ethical standards don’t have any legal basis. Legal standards set the limit in what should be done and what not to do (Creswell & Sheikh, 2018). Whereas ethical standards are based on human judgment on what is wrong and right, legal standards help in maintaining the order of how things are done by the help of authorities.
Healthcare has been dealing with mainly the problems of medical negligence, informed consent and confidentiality. To begin with, healthcare has developed legal issues that help to transform the healthcare, for example, the antitrust issues and ACOs that have helped in creating accountability and improving the quality of healthcare.
Secondly, the National Health Service has expedited the process of detecting fraud and the abuse of resources by physicians and healthcare providers (Macpherson & Segarra, 2020). Through the whistleblowers it has been known that some individuals defraud the government resources, thus has helped recover stolen money and property. To add on this is that the government has been working on reducing medical malpractice, and has come up with reform to reduce the cost of unnecessary services.
To conclude with the making of the informed decision before the treatment of the patient has been key because the physicians have to consider the risk and the health benefits to the patient. This is because of the documents showing the consent of the patient risk and the benefits of the decision.
