Introduction

The immigration law in the United States is complicated, and there is a wide range of confusion on the way it works. The U.S immigration law was created under the following guidelines: the family’s reunification, admission of immigrants possessing skills useful to the economy of the United States, refugee protection, and diversity promotion. The immigration policy gets governed by a body of law termed as The Immigration and Nationality Act (INA). The body offers permission to up to 675,000 immigrants who have a permanent visa in every year. Every year, the president is required to set the number of refugees to get admitted to the United States, with the help of Congress, through the United States Refugee Resettlement Process (Cox & Rodríguez, 2020). However, once an individual acquires an immigrant visa then they become a lawful permanent resident of the U.S. Through my experiences at the internship in Law Office of Mojgan Khoshvaght Gigasari I pointed out different ideologies in the immigration law, understood it at large and pointed out the changes that should get embraced to make the law better. This essay speculates the literature review and recommendations concerning immigration law.

Literature Review

Principally, for a nation with ultimate power, deciding who will get allowed to stay in their nation is a vital question. Besides, the united states cannot allow every individual in the globe who would like to live there, to do so. Although the society has a great capacity and with institutions to cater for such a happening, a very laissez-faire method would distinguish what it means to be a citizen. Broadly, every country’s citizenship comes along with obligations and rights, but it is up to the U.S institutions for democrats to make decisions on who should take part. The dilemma is the source of problems that counter immigration in America. The immigration policies are destined to limit entry and enforce laws restricting those getting to the country and stray those that seem undesirable.

In the late 1800s, people from different parts of the world left their homes and moved to America from American industrial research. They were fleeing from job and land shortages, crop failure, high taxes, and famine. They came to the USA since it had the perception that it was the land of economic opportunity. Some came looking for personal freedom since they were running from religious and political persecution. Therefore, with hope for a better future, over 12 million immigrants settled in America between 1870 and 1900. Most of them settled near ports. Different cities like those that were sparsely populated attracted immigrants by offering them jobs or farming land. Once they settled, immigrants searched for work. Besides, there were never enough opportunities for them, and employers took advantage of them. In that, men got paid less than other workers, and women were paid less than men. The immigrants suffered physical and verbal abuse from the stereotypes and discrimination (Cox & Rodríguez, 2020).

In the 1990s, immigration in the U.S grew by 11.3 million from history. After that, the impacts of immigration to countries like America have been looked at large. Through researchers’ conclusions, immigrants possess large impacts on unemployment chances and wages on the national population. There is little evidence concerning the economic importance presented in finding out if immigrants lower wages for native employees. Economic conditions and job chances play a huge role in individuals moving from one country to the other. Although it is appealing to check the roles of immigrants in the marketplace, we should first stipulate why we choose certain spots in the whole nation.

Through earlier researches (Lopez et al., 2017) on pointing out the reasons why some immigrants choose a certain location, we have come to an assumption that they settle in areas that earlier recorded higher immigrants’ presence. Studies by Al-Khatib & Rathod (2017) indicate that a foreign man will reside in a place with a similar ethnic population. Education also plays a major role during the choice of location; immigrants migrate internally in more frequent designs then natives in America. There is a major relationship between new immigrants’ destinations and the number of individuals born in the same country and raised in states. The major issue of refugees is that they have little or no influence on where they choose to settle. The U.S department has agreements with the resettlement of refugees’ bodies to track secondary immigration designs.

Researcher by Lopez et al. (2017) have tried to speculate models applied in determining immigration effects. Through conventional approaches, immigration from other countries sprouts due to low skill wages and higher unemployment rates. Others apply unorthodox methods to measure immigration causes by alternative mechanisms like mixes in regional, output, and participation of native labor force rates. Economically, the immigrants’ effects are felt unequally. Most companies in the U.S enjoy from diverse and larger workforce since most of the immigrants are concentrated on higher and lower skill ends of the workforce, which favors the U.S labor force, which is concentrated in the middle. Most American citizens possess high school diplomas and other postsecondary levels, whereas the immigrants get squeezed to the extremes having less than high school or only college degree.

Studies by Armenta & Alvarez (2017) indicate that immigration has boosted the economy of the U.S besides recent difficulties of maintaining its economic advantage and influence in the globe. If America loses its economic strength, then its power will reduce. Therefore, making the policy of immigration in the U.S right will be critical to the political and economic leadership. The current growth of the American labor force is through immigration, and similarly, the future growth will come from current workforces or immigrants delaying retirements.

Nonetheless, studies by Wadhia (2016) also indicate that other people commit immigration fraud by working, offering false data, or giving different individual information to acquire immigration passages. A business can also perform immigration fraud via solicitation. An individual or business can create a means for a person to get to America illegally. They can provide fake documents or forged by another individual, of which the owner of the details has been dead for years. Fraud is through false documentation or forgery. The business usually charges cash higher than the U.S Citizenship and Immigration Services. The problem with immigration fraud is that U.S authorities will have no way to monitor the foreign individuals getting to their country. Recommendations

When I was taking part in my internship at Law Office of Mojgan Khoshvaght Gigasari, I realized that the moment families include members with undocumented immigration standing, they: create separation with loved one’s fear, yields psychological stress plus it adds commercial hardship. Generally, children worry more when adults around them seem worried that something might happen. They can get distressed and experience emotional fluctuations in the independence of their age. On the other hand, parents worry on the way to cope with their young one’s behaviors and emotions (Johnson, 2018).

One design of coping with children’s emotions that I learned was frequent communication with their parents. Children often need information and to be given answers at any cost for their questions. As a parent, you should apply your children’s development stages and personalities to have a conversation with them. Nonetheless, America is a nation of immigrants (Torche & Sirois, 2019).

I have learned that America should encourage legal immigration since, at large, most other nationals come to the U.S to work. They come to America prospecting a better life, work, and proper wages, which were less available in their country of origin. As demonstrated by the current recession, the only design to discourage illegal immigration is to stop offering immigrants jobs. But when the American economy recovers, the demand for the task force will also rise. The current slowdown in the economy should get identified as a chance to slow down immigration in the U.S and serve the local people’s needs first until the economy shoots again. Therefore, creating an immigration policy that offers immigrants a timely means to venture to the united states will reduce undocumented immigration and encourage legal immigrants (Facchini, Margalit & Nakata, 2016).

Another idea I would recommend is that the U.S government strengthen its border measures. Generally, enforcement of borders is critical to nation safeguarding against illegal immigrants. With the current immigrant reforms that allow legal paths for immigration, border rules are needed to catch and deter those trying to get to America without proper authorization. Enforcements along borders are essential for national security but also a central section for American immigration procedures.

In conclusion, I learned that America’s national interests need a better immigration policy, which will assist the U.S in boosting its diplomatic, economic, and military standing globally. Therefore, the united states must generously welcome immigrants by an efficient and orderly legal design; they must immigrants possess an understandable and sensible visa and laws of immigration, which will allow access to both temporary and permanent visitors. Thus, the U.S must secure and control its borders, deny those who are not permitted entry plus deny work for those unauthorized to be in America.  A Task Force must take control despite the difficulties of passing the legislation (Wadhia, 2016).
