Develop a conceptual model of the key issues or theories – to consider when developing your Project Plan topics should include at least 2 or more of the following areas of law: (1)Business Structures, Partnerships and Corporations; (2)Business Related Offences and Ethics; (3) Torts; (4)Contract Law; (5) Sale of Goods and Australian Consumer Laws; (6) Property Laws, Leases and Intellectual Property

The case study is about the business structures and torts of Australian cabs and taxi industry. The opposition of UBER for the steps taken by the transport and infrastructure department of Australia for the renovation of ethics, structure, and laws of Australian taxi cab industry are displayed in the case study prepared by Codes and staff (2015). The steps taken by the government includes many supportive factors, compensations, rules, and basic procedures for the number plate owners or original owners of the taxi cabs. The key changes made by the government officials can be illustrated as below: –

Pending care safety checks, criminal cases associate with the cab drivers will be reinstalled with 50 taxi car regulations. These regulatory activities will be looked after by a dedicated regulator and commissioner in representation to the government.

The taxi drivers will be facilitated with a huge amount of Industry adjustment package of $ 250 million.

The aim of the government is to provide a safety service for the passengers and specifically the passengers who are availing the taxi service with a hope to get a satisfactory service.

Becoming the second city in Australia to legalize Uber’s activities.

The aim is to facilitate the cab driving society with more systematic rules and facilities by ensuring the fate of customers.

New job opportunities will be added to meet the increasing trends in the taxi industry.

These points are considered in making the new restructure of the rules. There is not much opposition as the making of the renovation is based on the public wants. Still, the taxi association demands more supportive points and want more compensation package. Though it is not possible for the government to accept all the demands of taxi association, the primary focus is to facilitate the citizen. The government is trying to establish a well-defined business structure and controlling the torts of the opposition parties. In the recent time, the renovation process will be emphasized more create a high-end cab driving service in the society (Taxitalk, 2012).

Outline of review methodology– to gather project data

The review methodology to analyze the situation more effectively in finding the real beneficial and harmful factors is needed. This could be done easily if the project data will be prepared resourcefully. The aim of the project case is to make a reform in the Australian taxi industry. The actual case is based on the situation at New South Wales, an Australian city. Being a popular city of Australia, the influence of the city’s overall corporate and service environments have a major impact on the total economy. The officials of New South Wales has already gained the support of Sydney; the all it need more is to earn more supporting hands from the other cities of Australia (Government of Australian capital territory, 2015).

Some factors are needed to consider in gathering the project data in a perfect way. As UBER is opposing some of the steps of government and demanding more appraisal decisions to be made, the actual benefit situation is needed to study thoroughly. The public review about the probable circumstances of post installation of the act. The website of infrastructure and regional development will help in collecting the project data meaningfully. As the government will update any changes made or steps taken in the actual execution of the act in the website, it will be easy to estimate the success probability. The Australian taxi industry association also has a vital role in criticizing the steps of government steps. In this case, the association is not opposing the proposals totally but fearing to lose the base taxicab environment. Different previous journals based on the demand of new public oriented rules regulations in the taxicab industry will also be helpful in preparing the project data. As the journals are based on a thorough study of situation, it will be easy to judge whether the steps taken by the government in the act is beneficial or not. As per the statement of New South Wales’ minister for transport and infrastructure Mr. Constance, the entire proposal is based on the public review only. He also added his point that, it can’t be said that how much success the act will get, but the government expects a strong foundation of the renovation (Government of NSW, 2016).

Case organization description, background, and context

In the making of the act, the most impact is going to face is UBER. UBER is a multinational taxicab service originated in the USA. With its innovative taxicab service by using the location based app, UBER has created a special image in the mind of customers (Rahel, 2016). This California-based company was founded by Travis Kalanick with an opinion to facilitate the public with a variety of taxicab service. Its app-based taxi service inspired the other service providers to add a new trend to their taxi cab service like UBER did. It has a global operation in 58 countries currently and expanding. As UBER is a franchise taxicab based company, the new act will impact its operation mostly. UBER IS consistently trying to establish a new patter into its global business operations from the year 2009 (Dong et. al. 2014).

The presence of UBER in Australia is established in the year 2014, five years after its introduction into the world. It is not an easy for everyone to spread the business like UBER did, but this got possible for the extravagant ideas, plans, and their formulation by the CEO Kalanick. A consistent effort addition and skill representation provided the management of UBER a better result (Chassin and Msaid, 2016). Currently, UBER not only operates a simple taxicab service like others but it has stepped its feet in self-driving cars, taxicab for different income segments, helicopter service, and many luxurious car services. In the Australian environment, The Company is facing different legal rules and regulations time to time. This scenario is affecting the business of UBER to a great extent (Stolte and Kente, 2016). The company officials are trying to establish a systematic procedure of its working module to facilitate its growth with the rules and regulations of different countries. The Australian transport department is preparing a model to shape the total transport system, basically the taxicab service. This modeling is making hindrances for the growth and development of UBER. As Australia is a reasonable size of a continent, a small change in the transport act affects the total operation of UBER throughout the country (Deloitte, 2016).

Review current business law and due diligence plan of case organization or strategic goals as defined by interviewing key managers, reading the organization’s annual report, business law and due diligence audits or other relevant sources

There is a total of 546 governing bodies in different cities throughout the country in Australia. The government has emphasized on safety, efficient and sustainable programs in the cities of Australia. It is essential to obey all the guidelines and prescribed rules for riding the cars and taxicabs in the road of the cities in Australia. As the prosperity of Australian continent, the rules and regulations are before change as per the need and situation time to time. The government thinks the wellbeing of its citizen as a priority and the change in rules and regulations of transport is mostly based on the changing need only. By the time, the government is trying to enhance the value of transport service by adding new technological trend settings and advancements. The department not only performs and plans regular strategic activities but also it assists the Australian government in making a standard framework. The plans of transport are based on the updated face of the technology and its appropriate application (Australian Government, Roads, 2015).

The central office of the department is located at Canberra and the regional and branch offices assisted by the directions given by the head office. The current scenario of the case is about a change or renovation in the previous act of the department. Several reforms have made by the department so far to influence the growth and development of Australia positively. Among the various programs undertaken by the department, The Infrastructure Programme is the most one having a long term benefit. With a huge investment in the program, the department is getting long term benefit from years, and it is going on. The program has some core components can be demonstrated as below: –

Direct link with the infrastructural development of roads throughout the country.

The funding activities for the improvement of local and regional transport

A single funding scheme is being followed by the department to keep parity in the fund distribution process to all the governing bodies across the country.

(Transport, Australia government, 2017)

Team’s perception of the case project, challenges, and opportunities – develop are search methodology to demonstrate how data will be collected in the case organization. Use the selected best practice model developed in assignment 1 (conceptual model) as the basis to review the current business law and due diligence management practices in the case organization. Once the current practices are identified, apply the MIRAT system for solving legal problems–all arguments are to be supported by cases and legislations properly cited by using Australian Legal Citation.

Our team members have gone thoroughly from the case study and marked several challenges and opportunities. The basic point used in the case study is when one side the department is trying to facilitate the citizen of New South Wales; a combined criticism is coming through. This scenario has kept us in trouble for a better understanding of the case. One side when the department is doing something for the favor of the people, and that’s based on the public opinion only, rather than supporting it the taxicab association is keeping a mixed review. The situation of UBER is also quite complex as the points UBER endorsing are not negative enough to make a valid argument for the department.

In the last assignment, we have elucidated the rules and regulations needed for UBER to follow in growing its operational activities throughout Australian economy. In this assignment, the taxi drivers are not satisfied with the compensation proposal of $250 million which is equivalent to $1 per taxicab ride for five years across all the cities of the country. In our point of view, it is not a case to judge the compensation factor. The taxi association has no comment for the other disciplined reforms made in context to the development of road trips, transport infrastructure. UBER and the other taxicab services should understand the benefit derived from the revolution of the act and wait for the improvement result. With the help of Conceptual model, the understanding and review can be demonstrated effectively.

The due diligence of the current rules and regulations of the infrastructure and regional development proposes to follow certain guidelines in making the conceptual model. The department guidelines in maintaining practical situation are not possible at all for the taxicab services. Mostly the developmental activities undergoing of UBER is facing the critical circumstances for a proper execution of its ideas. As shown in the model the rules, regulations, and situations are linked with each other to find out a possible solution to the conflict situation between the department, and the taxi associations across Australia. The due diligence rules are the priority the taxi companies need to make, rather than being in a conflict situation it is better to understand the situation and move ahead (Ministry of Transport and Infrastructure, 2010).

Other observations and conclusions

In the preparation of the report, we also closely read and went through the transport rules and regulations of Australian government available at the online website of the department. Rather than it, we also utilized my personal understanding and judging abilities to facilitate myself in preparing the report comfortably. There are clear misunderstandings among the parties that can be minimized with a better discussion of their representatives. When the department is giving its statement that the act is strategically established and prepared for the well-being of the citizens and taxi associations, the taxi associations along with UBER are criticizing it. We clarified a clear idea in preparing the report and believe that it will be useful in preparing the next assignment.

Summary

All the sections are prepared as per the given instruction of the assignment. The case study researched by Codes (2015) has a clear overview of the situation and the comments and criticizes of the government officials, minister, and the representatives of the taxi association. This helped me a lot to understand the personal understandings of the parties, and we also utilized my perception to complete the report effectively.
