Every company or an institution has its rules and regulations well- suited to the members to put their conduct acceptable at the workplace. Capstone Corporation is no exception since the workers have a way they are expected to behave for the success of the company and to give a good outcome. Paula is a victim who happens to fall on the wrong side of rules in the company, and she is faced with the full wrath of her unexplained actions. Legal claims are demands for property or money where one sues to get a rightful cut of the law regarding the case. Paula, as the offender of the Capstone Corporation rules, has no lawful demands to make over the actions that are taken against her according to the company management. Every company management’s role is to ensure that the workers are well informed of the regulations; hence, when Paula ignores the prohibited action to use the company’s social platform for self-interests, she is not justified. Paula sets an agreement to Freddy to purchase a Mustang by word of mouth, which can be said to be a contract, and both sides are required to honor it.
Everyone has a right to privacy to carry out themselves with respect without fear of humiliation and exposure. Commonly, people enjoy their rights at the expense of others because they fail to limit themselves to the boundaries that the law confines them in. Public property gives an equal share to everyone who wants to use it, and nobody can treat it as a personal item. In Paula’s case, she uses the company’s email to pass a private message, which is public property, and all the Capstone workers have equal rights to access the email. Majorly, company properties are used according to what the management spells out; hence Paula goes against the company rules and can’t be saved from public scrutiny. The legal act protects people against self-incrimination, where everybody is given a right to privacy on personal information. Paula is reprimanded and goes ahead to slander Capstone’s name, and Mikey’s too the manager. Defamation triggers the management to terminate Paula’s job, and the company forces her. There is no criminal offense in defamation of character from the personal social page; hence Capstone Corporation is not justified to end Paula’s Career. Paula is to be blamed for taking anger to affected her negatively and choose the road of vengeance. Slander is majorly word of mouth, and a judge can only listen with a strong argument and stern witnesses, all pointing that to be the truth. Social media is a common platform where people are allowed to air their ideas from a personal point of view, and Paula took part from her page; hence her privacy should be respected and not treated as an offense.
Human beings are born with broad freedom in all aspects of life. Speech is the way of communication through which people from different backgrounds can speak a common language and understand each other. In a world full of different races, cultures, and people with varied interests, it is not a surprise when people disagree on various incidences. People exercise their freedom of speech and tell that which they feel is right, depending on their moods, either anger or joy. People may not measure the intensity of their words, and they end up hurting others and causing chaos. Paula, like anyone else with feelings, she is heavy-hearted after she is reprimanded and chooses to express herself through the social platform about her manager and Capstone Corporation at large. Paula reveals her lack of satisfaction with the manager and the whole governing board of Capstone, and in return, they infringe her rights to privacy and freedom of speech by taking offense to her words. When people express their thoughts on things, they give a sincere view on it and can either be negative or positive. Also, people may provide an impaired opinion based on anger and hatred as Paula did and turns to be a victim of negative comments. Capstone lacks a legal basis to fire Paula based on her freedom to expression and speech towards the company and its management. People hate their weaknesses pointed out as they feel humiliated and even ashamed of the fact that they may not change or struggle to overcome it. Disparaging remarks on a company that you work for clearly shows a lack of respect and thankfulness, and hence it’s clear as a worker you can’t offer the best labor as expected. When you diminish the name of a member in management, it can result in employees disrespecting and questioning every directive given by such a leader. Paula deserves to be fired by the management decision but no legal basis.
Contracts are legal agreements made between two or more parties. All the legal agreements have essential elements to be enforced in a court of law. Contracts are classified verbally, in writing and with action all depending on what the parties are comfortable with. A deal is begun with an offer where details of the agreement are well said, and the terms and conditions are well set. An offer is extended, the offeree should revise and decide to accept or deny it or raise a suggestion on what and where to adjust the terms and conditions involved. Then, both parties make a mutual agreement on the contract and clear the way to proceed. In the consideration stage, something of value is exchanged to have a legal agreement valid. Usually, things that are transferred are like property, services protection, or products in exchange for money. Again both parties must be in a capacity fit for the agreement where they should have a legal age and of sound mind. Lastly, each of the parties should prove legal intend to mean that the results of the contract are entirely valid and legitimate. Paula and Freddy got into a legal agreement with was stated verbally to transfer Mustang the next day to Paula’s ownership for $1000. Freddy went against the contract by selling the Mustang to someone else despite the agreement and breaking his part of the deal to Paula. Paula is a victim of a broken covenant, and her side of the contract is honored; hence she is justified. Contracts are an excellent way to create trust and assurance to the people involved.
