The case presented Victoria who has HIV positive which she got during birth. Her mother insist that she should not be informed of her condition because it may result in emotional damage. Victoria’s mother has asked that the clinical staff not to disclose to her daughter that she is HIV positive. The Clinical staff are aware that Victoria has begun to be sexually active and sometimes she engages in sex with her boyfriend with any form of protection. This issue poses a significant risk to the boyfriend who could be infected with the condition too. The Clinical staff have not informed Victoria mother that she is sexually active. However, they have insisted that at 16 years is when most girls start being sexually active. Her mother still insists that her daughter is a attends church regularly and will abstain until marriage. This case has posed several ethical dilemmas for the clinical staff.
The best cause of action that the clinical staff should undertake is to inform Tina that her daughter is sexually active. The mother should be told that she has a boyfriend and sometimes they have unprotected sex. This action is likely to change the mother stance regarding the disclosure of the condition that the daughter has. At this age, Victor is a grown up and will be able to manage her condition. The clinical staff should encourage the mother to inform the daughter that she is HIV positive. However, the privacy of the mother will be threatened when she informs her daughter. Victoria’s mother will have to tell her daughter how she got the condition, and that is through birth. Therefore, the daughter will understand that the mother too has the condition. The main right that Victoria’s boyfriend has is to know her status before they engage in unprotected sex. This knowledge will ensure that they are keen and that they use protection whenever they are having sex.
Other approaches that the clinical staff can take when the mother is strong on her stance is to encourage the daughter always to use protection when having sex with her boyfriend. Since they have engaged in unprotected sex, the boyfriend is likely to have been infected. Therefore, clinical staff should insist that they get tested. These test will show that both of them have the condition with the mother disclosure. From this point, Victoria and her boyfriend will observe the necessary precaution such as medication as they have been found positive. Further information that may be required to suggest an ethical course of action is whether the daughter has psychological issues such as depression that may emerge when informed of the condition.
