It is a fact that peter demonstrated boldness while making his decisions and taking his actions, however, he was faced by the risks of getting his company incur losses or himself getting fired.it was obligatory for him to increase sales to new and existing customers at any cost because he was a new staff member. Nevertheless, instead of moving on with this step, peter went ahead to consult the customers and advised them to downgrade the package they had earlier subscribed. Factors which assist people in making decisions.
One of the factor which assist individuals make moral decisions while still facing a lot of pressure include autonomy. Autonomy is the principle addressing independence concepts. It also provides individuals with a platform and freedom of making their own choices and act accordingly (Pappas, 2016). Another fact is non-maleficence that is the concept of intending to harm other people. It reflects to the responsibility of contribution to customer’s welfare based on being proactive, harm preventive, and good. Article Judicial power
According to the author, judicial powers imply the authority granted to the court to decide and articulate judgment. It can be effected to parties as well as individuals who bring a case before the decision is made. It involves the process and rights of determining the actual controversies which arise among diverse litigants instituted duly in courts of law for efficient jurisdiction. Judicial power also include the authority to listen and determine the matter of subject in controversies among the peoples ta suit. The judiciary has been granted the power to deliver final judgments which everybody should respect. The judicial decision is also the last word from the judicial department regarding to a specific case and controversy (González, 2016). The author has highlighted that despite the power of the judiciary, the litigation reform act automatically stated that the current injunctions which remedy prisoners violations of rights was not amounted to unconstitutional legislative revision of a last judgment. Instead, the automatic stay interfered with prospective effect on injunctions.
Discussion on the article
According to the article, judicial power refers to the authority to deliver dispositive judgments. The power is highly protected by the constitution and it applies to all individuals regardless of the financial status and leadership position. The supreme and federal courts have been granted maximum authority to make decisions on particular cases and controversies which must be adhered with or appealed via proper guidelines. There must be two prerequisites which must be present in the entire jurisdiction apart from the supreme court. The first is the constitution which must give all the courts the power and authority. The second party is the act of congress which it is obligatory to confer with.
The possible abuse of judicial power was always a point of concern which alerted our founding fathers. The concerns led them to establish several limits on the circumstances that cases were considered by the court. There was formation of a delegate that proposed to the extension of judicial powers. They delegate also went beyond consideration of treaties, laws and policies including the cases that arose under the constitution. Many individuals thought that it was too far to extend the powers of the courts since this would be eliminating power from the hands of the citizens (Treves, 2017). On my own perspective, the limited power on federal courts may result to litigants in them: this would make it necessary for affirmative establish to the already existing jurisdiction and not adhere with non-existing jurisdiction either by conduct or consent. Most of the people believe that finality of the judgment is the most essential attribute to indicate judicial powers. However, I believe that the relationship and influence the court leaves to the conflicting powers should be the aim of the judiciary. It should not only focus on implement justice only, instead, making sure that the conflicting parties are in terms and in good relationship condition should also be top priority. The powers also should not be only exercised to a certain class and status of people. There has been instances where the powers have been abused to unfairly make judgments on the poor or those with no influence in the society. Everybody in power should use it in a fair way and for the benefit of the majority.
